DEFENCE OF THE FIRST DEFENDANT

1. The Defendant contends that this suit, along with Suits No. 2523, 2524 and 2525 of 1996 and Suits No. 70, 76, 82, 172, 181, 182, 187 and 188 of 1997 (" the related actions") is an abuse of the process of the Court and should be struck out or stayed. This Defence is served without prejudice to that contention.

2. Paragraphs 1 to 13 of the Statement of Claim are admitted.

3. Paragraph 14 of the Statement of Claim is admitted, save that it is averred that the words complained of do not refer to the Plaintiff.

4. Paragraph 15 and 16 of the Statement of Claim are admitted.

5. It is denied that the words spoken by the First Defendant bore the meanings alleged in paragraph 17 of the Statement of Claim.

6. Paragraph 18 of the Statement of Claim is denied.

7. Paragraph 19 of the Statement of Claim is denied.

8. Paragraphs 20 to 31 of the Statement of Claim are admitted.

9. Paragraph 32 of the Statement of Claim is admitted, save it is denied that the words complained of are defamatory of the Plaintiff.

10. The Defendant admits that he is responsible in law for the republication in the Straits Times of the words admittedly spoken by him. In all other respects paragraph 33 of the Statement of Claim is denied.

11. Paragraph 34 of the Statement of Claim is admitted, save it is denied that the words complained of are defamatory of the Plaintiff.

12. Paragraph 35 of the Statement of Claim is denied.

13. Paragraph 36 of the Statement of Claim is admitted.

14. It is denied that the words complained of bore the meanings alleged in paragraph 37 of the Statement of Claim.

15. Paragraph 38(a) of the Statement of Claim is not admitted. Paragraph 38(b) is denied.

16. Paragraph 39 and 40 of the Statement of Claim are denied.

17. It is denied that the Plaintiff is entitled to aggravated damages whether by reason of the matters particularised in paragraph 41 of the Statement of Claim or at all. Paragraph 41 of the Statement of Claim is denied. It is averred that the Plaintiff’s failure to plead that the action for slander is actionable under the law of Malaysia results in the Statement of Claim disclosing no cause of action for slander.

18. Unless expressly admitted above, all allegations in the Plaintiff’s Statement of Claim are denied and the Plaintiff put to strict proof of them.
